Terms of Use

These Terms of Use (“Terms”) are a binding agreement between you and Accordance LLC, doing business as ClearedFor (“ClearedFor,” “we,” “us”) governing your access to and use of the ClearedFor service, including signing permission slips, managing activities, and maintaining rosters (the “Service”). By accessing the Service, signing a permission slip, or creating an account, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

1. Eligibility

The Service is intended for adults. You must be at least 18 years old (or the age of majority where you live) to create an account or sign a permission slip. The Service is not directed to children, and children may not use it directly. Information about a youth is provided by their parent or guardian, who is responsible for it.

United States only. The Service is offered only in the United States. By creating an account or signing a permission slip you confirm that you are located in the United States, and you agree not to use the Service from outside the United States. The Service is built around U.S. electronic-signature law (see Section 5), and we and our service providers process and store information in the United States, as described in our Privacy Policy.

2. The Service

ClearedFor lets activity leaders create activities and lets parents and guardians review and electronically sign permission slips for those activities. Leaders can track who has signed and access an emergency roster for an activity. An activity may also require a parent or guardian to upload a document that was completed and signed outside the Service (for example, a provider-completed physical) or to answer a short survey the leader sets; these items are collected to help run the activity and are not electronically signed through the Service. The Service is a record-keeping and signing tool only. It is not a healthcare, legal, transportation, supervision, or emergency-response service, and it does not provide medical or legal advice. You remain responsible for the safety, supervision, and care of any youth, and for any decisions you make in an emergency.

3. Accounts and verification

Using the Service — including signing a permission slip — creates a free ClearedFor account tied to your email address. We verify control of that email with a one-time code; we do not use passwords or text messages. You agree to provide an accurate email address, to keep control of the email you use to verify, and to be responsible for activity that occurs through your account. Verifying an email proves control of that address; it is not by itself proof that you are a youth’s parent or guardian (see Section 5).

4. Organizations, leaders, and ownership of records

Activities and signed records belong to the organization that runs the activity, not to any individual leader. Owners and leaders are delegates of the organization and their access can rotate, be added, or be revoked. If you are an owner or leader, you agree to use the Service and any youth or signer information only for the legitimate purpose of running the organization’s activities, to limit access to leaders who need it, and to comply with applicable law (including privacy and child-protection law). You may not collect, export, or retain signer or youth information for any other purpose.

Uploaded form documents. Leaders may upload form documents (for example, a permission slip or an outfitter’s waiver) as templates for their organization’s activities. By uploading a document you represent that you have the right to use it for those activities. Uploaded documents are stored privately for your organization. To operate and improve the Service — for example, to recognize commonly used forms — we also retain limited upload metadata: a cryptographic fingerprint of the document’s content, its file size and file name, and counts of how often that exact document is uploaded. This metadata is not the document; outside your organization’s own private storage we do not keep a copy of any uploaded document. Metadata for forms we have not seen in six months is deleted automatically. To ask us to remove upload metadata sooner, contact us at privacy@clearedfor.org.

Documents you upload as a parent or guardian. An activity may ask you to upload a document that a provider or other third party completed and signed outside the Service (for example, a health form or physical). ClearedFor collects and stores that document so the activity’s leaders can confirm it was provided; we do not verify the identity or qualifications of whoever completed it, the authenticity of any signature on it, or whether its contents are accurate, complete, or sufficient for the activity. You represent that you are authorized to share the document and that the activity needs it. An uploaded document is encrypted and deleted on a retention schedule, as described in our Privacy Policy.

Activity surveys. A leader may include a short survey — for example, a shirt size, meal choice, pickup arrangement, or skill level — that you answer for your youth. A survey collects planning information for the activity. It is not a signed document, not a consent, and not a medical or legal record, and answering it does not create or replace a permission slip. Survey answers are encrypted and deleted on a retention schedule, as described in our Privacy Policy.

5. Electronic signatures and consent to do business electronically

The Service uses electronic records and electronic signatures. By signing a permission slip electronically, you consent under the U.S. ESIGN Act and applicable state Uniform Electronic Transactions Act (UETA) to conduct the transaction electronically and to receive related records electronically. You agree that your electronic signature is the legal equivalent of your handwritten signature.

  • Accuracy and authority. You represent that the information you enter is accurate and that, when you attest you are a youth’s parent or guardian, you in fact have that authority. You are solely responsible for the truth of your attestation and the data you provide.
  • Withdrawing consent. You may withdraw consent to a signed slip at any time from your dashboard — sign in with a code sent to your account’s email address. Withdrawing consent may remove a youth’s clearance to attend an activity.
  • Records. We keep a record of your signature (a certificate) as described in the Privacy Policy; sensitive details are encrypted and deleted on the schedule described there.

6. Acceptable use

You agree not to:

  • Sign for, or enter information about, a youth you are not authorized to represent.
  • Provide false, misleading, or another person’s contact or identity information.
  • Access an activity’s roster or any signer or youth information without authorization, or use it for any purpose other than running the activity.
  • Attempt to breach, probe, or circumvent the Service’s security, access controls, or rate limits, or interfere with its operation.
  • Use the Service to violate any law, infringe others’ rights, or harm or endanger any person, including any minor.
  • Use automated means to scrape or harvest information from the Service.

We may suspend or terminate access that violates these Terms or that we reasonably believe puts any person’s safety or information at risk.

7. Payments and credits

Parents and guardians always sign for free. Only an organization pays, by purchasing prepaid credits held as an organization balance. A credit is consumed when an activity is published for signing. Credits are non-expiring and tied to the organization. If an activity is canceled before any signature is collected, the credit is refunded to the balance; once signatures are collected, the credit is consumed and is not refundable. Prices and credit values may change prospectively. We do not monetize your personal information.

8. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that email messages will be delivered or delivered on time. The emergency roster and signing records are tools to assist you; you are responsible for verifying information and for the care and supervision of any youth. To the extent any warranty cannot be disclaimed, it is limited to the minimum permitted by law.

9. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, CLEARED FOR AND ITS OWNERS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, INJURY, OR HARM ARISING FROM AN ACTIVITY, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF THE AMOUNT THE RELEVANT ORGANIZATION PAID US FOR THE ACTIVITY GIVING RISE TO THE CLAIM IN THE PRIOR TWELVE MONTHS OR USD $50. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you; nothing in these Terms limits liability that cannot be limited by law.

10. Indemnification

You agree to indemnify and hold harmless ClearedFor from claims, losses, and expenses (including reasonable legal fees) arising out of your breach of these Terms, your misuse of the Service, the accuracy of information you provide, or your authority (or lack of authority) to sign for a youth.

11. Suspension and termination

You may stop using the Service at any time. We may suspend or terminate access for any user or organization that violates these Terms or applicable law. Provisions that by their nature should survive termination — including ownership of records, disclaimers, limitation of liability, indemnification, and governing law — survive.

12. Governing law

These Terms are governed by the laws of the State of Utah, USA, without regard to its conflict of laws rules, and you agree to the exclusive jurisdiction of the state and federal courts located in Utah for any dispute, except where applicable consumer-protection law gives you the right to bring a claim in your home jurisdiction.

13. Changes to these Terms

We may update these Terms from time to time. When we make material changes we will update the “Last updated” date above and, where appropriate, provide additional notice. Your continued use of the Service after an update means you accept the revised Terms.
